1.2. By accessing, registering with, or otherwise using the Platform, you acknowledge and agree that your Personal Information will be processed in accordance with the terms of this Policy and any applicable data protection laws.

1.3. TravelVerse is committed to safeguarding the privacy, confidentiality, and security of your Personal Information. This Policy is intended to provide you with clear and transparent information regarding:
a) the categories of Personal Information we collect;
b) the purposes for which such Personal Information is collected and processed;
c) the manner in which Personal Information may be used, stored, and disclosed;
d) the rights and choices available to you under applicable law; and
e) how you may contact us regarding our privacy practices.

1.4. This Policy applies to all users of the Platform, including but not limited to visitors, registered account holders, and individuals interacting with TravelVerse through customer support channels, promotional activities, or partner integrations.

2. How We Use Your Personal Information

2.1. The Personal Information that we collect, hold, use, and disclose is collected for the primary purpose of enabling TravelVerse to provide a seamless, secure, and personalized travel experience. Such processing is necessary for the performance of our contractual obligations, compliance with legal duties, and the pursuit of our legitimate business interests, as permitted by applicable data protection laws.

2.2. By accessing or otherwise interacting with the Services, you hereby acknowledge and expressly consent to TravelVerse’s collection, use, retention, and disclosure of your Personal Information for the following purposes:
a) Provision of Services: To operate, administer, and grant you access to tours, cultural experiences, Points of Interest, incentives, and all related functionality within TravelVerse;
b) Account Administration: To establish, verify, maintain, and secure your TravelVerse account, including authentication, fraud prevention, and identity verification;
c) Personalization: To tailor and enhance your user experience, including, without limitation, the provision of recommendations, curated itineraries, and incentive-based features aligned with your preferences and usage history;
d) Rewards and Incentives: To issue, validate, and manage digital rewards, including Non-Fungible Tokens (NFTs) serving as Proof of Visit or Proof of Interest, and to facilitate access to discounts, benefits, and privileges offered by TravelVerse’s partner network, including hotels, restaurants, and other service providers;
e) Partner Integration: To facilitate your engagement with TravelVerse’s contractual partners and vendors, including but not limited to hotels, cultural institutions, event organizers, and other service providers that collaborate with TravelVerse;
f) Communications: To transmit operational notices, confirmations, account updates, and service-related messages, as well as promotional or marketing communications where legally permissible;
g) Service Improvement: To monitor, analyze, and evaluate trends, usage patterns, and user behavior for the purpose of improving the Services, developing new features, and optimizing performance and security;
h) Safety, Security, and Compliance: To safeguard the integrity of the Services, prevent unlawful activity, enforce contractual rights, and ensure compliance with applicable laws, regulations, and governmental requests;
i) Legal Obligations: To fulfill obligations under applicable laws and regulatory frameworks, including but not limited to the General Data Protection Regulation (GDPR) and other relevant data protection laws.

2.3. TravelVerse shall not process Personal Information for any purpose incompatible with those expressly stated herein, except where required or authorized by applicable law.

10. Information for California Residents

10.1. TravelVerse is incorporated and headquartered in Switzerland at Rue du Château 21, 2000 Neuchâtel, and is subject to the data protection laws of Switzerland and, where applicable, the European Union General Data Protection Regulation (GDPR). Accordingly, this Privacy Policy has been drafted primarily in compliance with such legal frameworks.

10.2. Notwithstanding the foregoing, certain users may access the Platform from jurisdictions outside of Switzerland, including the State of California, United States of America. To the extent that the California Consumer Privacy Act of 2018 (“CCPA”), as amended, is deemed to apply to TravelVerse, the following supplemental disclosures are provided for California residents. For purposes of this Section, the term “personal information” shall have the meaning ascribed to it under the CCPA.

10.3. Subject to verification of your identity and any applicable limitations under law, California residents may have the following rights:
a) Right of Access: To request disclosure of (i) the categories of personal information collected; (ii) the categories of sources from which such personal information was collected; (iii) the business or commercial purposes for which the information was collected; (iv) the categories of third parties with whom such information was shared; and (v) the specific pieces of personal information collected during the preceding twelve (12) months;
b) Right to Request Deletion: To request the deletion of personal information collected from you, subject to exceptions provided under the CCPA;
c) Right to Non-Discrimination: To exercise CCPA rights without receiving discriminatory treatment from TravelVerse.

10.4. Requests to exercise these rights may be submitted by email to [email protected]. In order to protect the integrity of your Personal Information, TravelVerse may require additional verification information (such as date of birth, user identification number, or other reasonable identifiers). If we are unable to verify your identity, we reserve the right to deny the request in accordance with applicable law. Deletion requests will require confirmation by email.

10.5. California residents may designate an authorized agent to act on their behalf by providing valid proof of authorization, including a duly executed power of attorney under California Probate Code §§ 4000–4465. TravelVerse reserves the right to reject any request submitted by an agent that fails to demonstrate sufficient authority.

10.6. TravelVerse shall not be obligated to provide access to personal information more than twice within any twelve (12) month period. Requests that are manifestly unfounded, excessive, or abusive may, at TravelVerse’s sole discretion, result in the imposition of a reasonable administrative fee or a refusal to act on the request, in which case the requester shall be notified accordingly.

10.7. For the avoidance of doubt, nothing in this Section shall be construed as expanding TravelVerse’s obligations beyond those expressly imposed by applicable law.

Updates to This Privacy Policy

We may revise or update this Privacy Policy from time to time to reflect changes in our practices, operational requirements, legal obligations, or to enhance user experience. Any modifications will be effective when posted on this page, and the “Last updated” date at the top of this document will be adjusted accordingly. Your continued use of TravelVerse following the posting of updates constitutes acceptance of those changes.

Terms of Use

These terms of service (“Terms”) apply to the use of the platform TravelVerse (“TravelVerse.live”, “TravelVerse”, “TVO”, “we,” or “us”) provides through its website TravelVerse.live together with all other websites, mobile applications, communications via Facebook, Telegram, email, or any other means we use, and services operated by or on behalf of TravelVerse (1World Online) (the “Site”), to you, an individual user (“you”) for your individual usage, subject to compliance with the terms and conditions set forth herein.

By accessing the Platform, you agree to be bound by these Terms, whether or not you make any purchases offered by TravelVerse. These Terms constitute a legally binding contract, and you must accept them to use the Platform. If you wish to use the Platform or browse it in any way, please read these Terms of Use. Our Platform is meant to provide you with information about our services, destinations, user tools, a means to contact us, and access to our other functionalities.

You should also read our Privacy Policy, which is incorporated by reference into these Terms and is available for you to view through the Platform. These Terms also include any other terms we disclose and which you agree to upon the purchase or use of additional features, products, or services we offer through the Platform, such as terms related to promotions or discounts. Do not use the Platform if you do not accept and agree to be bound by all of the terms of these Terms, including our Privacy Policy and other such terms.

You represent and warrant that you are of legal age to form a binding contract. If you are agreeing to these Terms on behalf of an organization or entity, you represent and warrant that you are authorized to agree to these Terms on that organization’s behalf and bind them to these Terms (in which case, the references to “you” and “your” in these Terms, except for in this sentence, refer to that organization or entity). We reserve the right at any time, with or without cause, to change the terms and conditions of these Terms or to modify the Platform, including eliminating or discontinuing any content, services, or features of our platform. Any changes we make will be effective immediately upon our making such changes available on our website or otherwise providing notice. You agree that your continued use of the Platform will constitute your agreement to be bound by the changed Terms.

Use Of The Platform

You are responsible for:
– making all arrangements necessary for you to have access to the Platform;
– ensuring that all persons who access the Platform through your internet connection are aware of these Terms and comply with them.

In order to access the Platform or some of the resources it offers, you may be required to provide certain registration details, such as your name, phone number, email address, or travel preferences. You are solely responsible for any information you provide to us. You represent and warrant that your personal information is true, legal, accurate, non-fraudulent, and solely yours. You may not impersonate, imitate, or pretend to be somebody else when providing any information on the Platform. You agree that all information you provide to register with this Platform or otherwise, including but not limited to through the use of any interactive features on the Platform (such as booking tools, reviews, or support chat), is governed by our Privacy Policy, and you consent to all actions we take with respect to your information consistent with our Privacy Policy.

If you choose, or are provided with, a user name, password, or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any other person or entity. You also acknowledge that your account is personal to you and agree not to provide any other person with access to this Platform or portions of it using your user name, password, or other security information. You agree to notify us immediately of any unauthorized access to or use of your user name or password or any other breach of security. You also agree to ensure that you exit from your account at the end of each session. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information.

We have the right to disable any user name, password, or other identifier, whether chosen by you or provided by us, at any time, in our sole discretion, for any or no reason, including if, in our opinion, you have violated any provision of these Terms.

You understand that your content (not including credit card information) may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

Third Party Services

If the Platform provides you with an opportunity to engage with third-party services and links to third-party websites and services (collectively, “Third Party Services”), these Third Party Services are provided for your convenience only. TravelVerse does not have any control over these Third Party Services and accepts no responsibility for them or for any loss or damage that may arise from your use of them.

These Terms do not apply to any Third Party Services and do not govern the practices of the providers of such Third Party Services. When utilizing Third Party Services, you should read the relevant terms of use and privacy policies of those services. If you decide to access any of the Third Party Services available on or linked through this Platform, you do so entirely at your own risk and subject to the terms and conditions of use for such Third Party Services.

Proprietary Rights

TravelVerse grants you a non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Platform solely under the terms and conditions provided hereunder and/or any applicable terms related to you in connection with purchases or selections you make with respect to the Platform.

TravelVerse and/or its licensors own the Platform, including all software and other technology provided or employed by TravelVerse in connection with the Platform, and the content, design, layout, functions, appearance, and other intellectual property comprising or contained or available on the Platform, including all copyrights, trademarks, service marks, trade secrets, patents, and other intellectual property rights inherent therein or appurtenant thereto. Any authorized use of TravelVerse content shall be accompanied by an attribution to TravelVerse and a link to the relevant content on our Platform.

TravelVerse does not grant any licenses to any copyrights, patents, trademarks, trade secrets, or other intellectual property rights other than the limited rights to use the Platform, as set forth herein and subject to these Terms.

The Platform may also contain intellectual property of third parties, including service marks and trademarks. Your use of this Platform does not give you any right or license to use such intellectual property without the prior written permission of the corresponding intellectual property owner.

These Terms permit you to use the Platform for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Platform, except as follows:

Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
You may store files that are automatically cached by your web browser for display enhancement purposes.
You may print one copy of a reasonable number of pages of the Platform for your own personal, non-commercial use and not for further reproduction, publication, or distribution.
If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by our end-user license agreement for such applications.
If we provide social media features with certain content, you may take such actions as are enabled by such features. You must not:
– Modify copies of any materials from this Platform;
– Use any illustrations, photographs, video or audio sequences, or any graphics separately from the accompanying text;
– Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from this Platform;
– Access or use for any commercial purposes any part of the Platform or any services or materials available through the Platform.

If you print, copy, modify, download, or otherwise use or provide any other person with access to any part of the Platform in breach of these Terms, your right to use the Platform will stop immediately and you must, at our option, return or destroy any copies of the materials you have made.

All rights not expressly granted herein are reserved by TravelVerse. Your use of this Platform does not grant you ownership rights of any kind in the Platform.

Confidentiality

As a result of your use of the Platform, whether due to any intentional or negligent act or omission, we may disclose to you or you may otherwise learn of or discover our documents, business practices, source code, object code, management processes, day-to-day operational methods, partner arrangements, platform capabilities, systems, current and future strategic plans, marketing data, financial information, software, algorithms, vendor integrations, third-party relationships, processes, procedures, methods, and other aspects of our business ("Our Information"). You hereby agree and acknowledge that any and all of Our Information is confidential and shall be our sole and exclusive intellectual property and proprietary information.

You agree to use Our Information only for the specific purposes permitted by the use of the Platform and in accordance with these Terms. Any disclosure of Our Information to any third party, especially a direct competitor, is strictly prohibited and will be vigorously pursued in a court of law.

All obligations related to confidentiality contained herein shall survive the termination of these Terms. Furthermore, you acknowledge that Our Information is proprietary, confidential, and extremely valuable to us, and that TravelVerse would be materially harmed by any unauthorized disclosure of such information. You further acknowledge and agree that monetary damages may be insufficient to remedy a breach of this confidentiality obligation, and that TravelVerse shall be entitled to seek injunctive relief in addition to any other remedies available under law or equity.

User Conduct

In using the Platform, you agree that you will not:
– violate any applicable international, national, state, provincial, or local laws, regulations, or rules (collectively, “Laws”) as a result of your use of the Platform;
– make any information available to TravelVerse if doing so would violate any applicable Laws, industry standards, professional codes, contractual or fiduciary obligations, confidentiality obligations, employer policies, or any other requirements to which you are bound;
– transmit any information, data, images, or other materials, or post any content on the Platform, that contains vulgar, profane, abusive, or hateful language; epithets or slurs; offensive or inflammatory content; personal, racial, or religious attacks; or expressions of bigotry, racism, discrimination, or hate; or that is unlawful, harmful, threatening, harassing, defamatory, obscene, or otherwise objectionable; or that may invade another's privacy or infringe on intellectual property or proprietary rights, including but not limited to copyrights, trademarks, service marks, patents, or trade secrets;
– provide any false or misleading information to TravelVerse;
– impersonate or attempt to impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity;
– violate or attempt to violate the security of the Platform, including (without limitation) by logging into or attempting to log into a server or account that you are not authorized to access; testing, scanning, probing, or attempting to hack the vulnerability of the Platform or any system or network connected to the Platform; breaching security or authentication measures; or interfering with the Platform by overloading, flooding, mail-bombing, or crashing it;
– reverse engineer, decompile, disassemble, or otherwise attempt to reconstruct, identify, or discover any source code, underlying structure, user interface, or algorithms related to any portion of the Platform;
– “scrape,” copy, transfer, transmit, or display any information, data, software, interfaces, code, widgets, tools, or other materials contained in or accessible by means of the Platform (“TravelVerse Information”) for any purpose not expressly authorized herein;
– use or attempt to use any engine, software, tool, agent, or other device or mechanism (including but not limited to browsers, spiders, bots, robots, avatars, or intelligent agents) to navigate or search the Platform, other than the search engines and search agents made available by TravelVerse or generally available to the public (e.g., Mozilla Firefox, Google Chrome, Apple Safari);
– harvest or collect TravelVerse Information, user data, or contact information from the Platform by electronic or other means, including but not limited to scraping, for the purpose of sending unsolicited emails or other communications;
– copy, mirror, or otherwise attempt to replicate or reproduce the Platform or any of its components without prior written authorization from TravelVerse;
– attack the Platform via a denial-of-service (DoS) or distributed denial-of-service (DDoS) attack; or
– otherwise attempt to interfere with or disrupt the proper functioning, security, or accessibility of the Platform.

Reliance On Information Provided

The information presented on or through the Platform is made available solely for general informational purposes related to travel services, destinations, products, and offers. TravelVerse does not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such material is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such content by you, any other visitor to the Platform, or by anyone who may be informed of its contents.

This Platform may include content provided by third parties, including travel suppliers, booking partners, content licensors, syndicators, aggregators, and/or reporting services. All statements and/or opinions expressed in these materials, and all articles, reviews, suggestions, or responses to questions and other content, are solely the opinions and responsibility of the person or entity providing those materials. These materials do not necessarily reflect the opinion of TravelVerse. We are not responsible, or liable to you or any third party, for the content or accuracy of any materials provided by any third parties.

We may update the content on this Platform from time to time, but the content is not necessarily complete or up-to-date. Any of the material on the Platform may be outdated at any given time, and we are under no obligation to update such material.

Release Of Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL TRAVELVERSE, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE Platform, ANY SERVICES, ANY PlatformS LINKED TO IT, ANY CONTENT ON THE Platform OR SUCH OTHER PlatformS, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

TRAVELVERSE MAKES NO WARRANTIES THAT YOUR USE OF THE Platform OR ANY MATERIALS AVAILABLE ON OR THROUGH THE Platform WILL NOT INFRINGE ON THE RIGHTS OF OTHERS. TRAVELVERSE ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY ERRORS OR OMISSIONS IN SUCH MATERIALS, INFORMATION, SOFTWARE, OR SERVICES. ANY TRAVEL ADVICE, DESTINATION INFORMATION, OR SERVICE RECOMMENDATION IS FOR GENERAL INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE PROFESSIONAL OR LEGAL ADVICE.

Indemnification

You hereby agree to indemnify, defend, and hold harmless TravelVerse and its subsidiaries, affiliates, officers, directors, managers, shareholders, employees, agents, representatives, and authorized licensees from and against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind (including reasonable attorneys' fees and disbursements) arising out of or relating to your use of the Platform or any violation by you of these Terms, including but not limited to:
– your breach of any representation, warranty, or obligation under these Terms;
– your use or misuse of the Platform, its content, or services;
– any claim that your content or use of the Platform violates any applicable law or infringes the rights of any third party;
– any activity undertaken from your account, whether or not authorized by you.

TravelVerse reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In such case, you agree to cooperate with TravelVerse in the defense of such matter.

Severability

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms will continue in full force and effect.

Governing Law & Jurisdiction

All matters relating to the Platform and these Terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of Switzerland, without giving effect to any choice or conflict of law provisions.

You agree that the courts of Zurich, Switzerland shall have exclusive jurisdiction over any legal suit, action, or proceeding arising out of, or related to, these Terms or your use of the Platform.
